GAMESCAPE TERMS AND CONDITIONS

GENERAL RULES

  1. The terms used in these regulations ("Terms") mean:
    1. Gamescape – Gamescape Limited Liability Company, located in Krakow, Kościuszki St. 74, 30-114 Krakow, KRS number: 0000666086, NIP: 6751584536, REGON: 3366698296, phone: +48 789 315 401, email: hello@gamescape.pl;
    2. Game – a game organized by Gamescape such as: Escape Room, City Game (Escape City), mobile Escape Room (Escape Box), or virtual Escape Room (Escape Online);
    3. Room – the room where the Escape Room type game takes place;
    4. Booker – a person making a reservation or purchasing a Game;
    5. Party Room – a room at Gamescape's premises made available to participants of Escape Room type games and City Games after the game ends;
    6. Participant – a physical person participating in the Game;
    7. Gamescape Employee – a person authorized by Gamescape to perform activities related to serving Participants.
  2. These Regulations define the conditions and rules for Participants' involvement in the Games.
  3. The price list for services provided by Gamescape is available on the website https://gamescape.pl/. https://gamescape.pl/.
  4. The Booker and Participants are required to familiarize themselves with the Regulations and to adhere to its provisions. Booking or purchasing a Game or participating in a Game means accepting the Regulations.

RESERVATIONS AND PURCHASE

  1. Reservations for Games can be made, in particular:
    1. through the website https://gamescape.pl/ oraz https:// https://escapecity.pl/ (exclusively for business entities),
    2. via email at hello@gamescape.pl, hello@gamescape.pl, lub też –

w godzinach pracy Gamescape:

    1. by phone,
    2. in person at Gamescape's headquarters.
  1. The conditions for reservations made through the website (para. 1 lit. a) are specified in the Regulations for the provision of electronic services, available at: https://gamescape.pl/regulamin/. https://gamescape.pl/regulamin/.
  2. Gamescape may also enable booking specific types of Games through external services. The conditions for making such reservations will be specified in the Regulations mentioned in para. 2 or in the regulations applicable within these services.
  3. A game reservation is considered successfully made at the moment the Booker receives confirmation of the reservation. In the case of reservations made online, especially in the manner specified in para. 1 lit. a and b, this confirmation is sent to the email address provided by the Booker, while in the case of a telephone reservation (para. 1 lit. c) – it is sent via SMS to the phone number provided. Reservations made in person at Gamescape's headquarters (para. 1 lit. d) do not require additional confirmation.
  4. If a reservation for a Game is successfully made and payment for tickets at the time of booking is not made, the Booker should make payment for the tickets for the reserved Game at the game's location, no later than 15 minutes before its start.
  5. Gamescape may introduce promotional offers. Details of the promotions are defined on the Gamescape website https://gamescape.pl https://gamescape.pl/ and are available at the game's location.
  6. The Booker receives a sales document in the form of a receipt or a VAT invoice. Issuing a VAT invoice requires announcing the desire to receive a VAT invoice at the time of booking and providing the NIP and other necessary data (in person or to the address: hello@gamescape.pl).
  7. In the case of a successful reservation of an Escape Room type Game or a City Game (Escape City), Gamescape commits to preparing to provide services on the selected date by the Booker, which particularly means:
    1. in the case of an Escape Room type Game – not making the particular Room available to third parties (other than Participants indicated by the Booker) on the selected date, subject to para. 6;
    2. in the case of a City Game (Escape City) – preparing to make available the equipment and props needed for the specific City Game on the selected date.
  8. The Booker may cancel the reservation no later than 24 hours before the scheduled game date. Cancellation of the reservation should occur under the same conditions as making the reservation – para. 1 lit. b-d and para. 4 apply correspondingly in this case.
  9. The Booker and Participants acknowledge and accept that, due to the obligations described in para. 8, failure to appear at the game's location on the selected date or failure to participate in the Game for reasons attributable to the Participants (including due to non-compliance with the Regulations by the Participants) does not exempt from the obligation to make payment for the game tickets, nor does it entitle to a refund of the amount already paid for the reservation or purchase of tickets.

SAFETY RULES

Escape Room

      1. Participants are obliged to comply with the rules of social coexistence, fair and safe gameplay, including the rules specified in the Regulations, and applicable laws.
      2. Before starting the Game, the Participant should leave all items and remove any clothing items that may be damaged or pose a hazard during the Game (e.g., sunglasses, jewelry, watches).
      3. Participants should be dressed in attire that allows comfortable and unrestricted movement, suited to the nature of the Game. Gamescape informs that participation in the Game may involve the necessity to squeeze through narrow gaps or the possibility of clothing getting dirty. The Participant should not wear attire during the Game that is prone to damage or of significant value.
      4. Gamescape is not responsible for any damage to property, including clothing and personal items of the Participant, resulting from participation in the Game, caused by the Participant's non-compliance with the guidelines resulting from para. 2 and 3.
      5. In the Rooms, flashing lights, strobe lights, or tight spaces, narrow passages, and other factors that may cause stress or other sudden reactions in Participants may be used – they are listed in the descriptions of individual Rooms available on the Gamescape website https://gamescape.pl/ and at the game's location. Persons not fully healthy or in a condition requiring increased caution (i.e., particularly persons with epilepsy, suffering from cardiovascular diseases, claustrophobia, arachnophobia, pregnant women) should not participate in Games in which factors that may pose a potential risk of negative impact on their health condition are present. In the case of contraindications to participation in a specific Game, the Participant participates at their own risk.
      6. Before making a choice of a Game, the Booker is obliged to familiarize themselves with the factors mentioned in para. 5 and inform all Participants about them.
      7. If the Game is to be attended by children, disabled persons, or pregnant women, this should be reported to a Gamescape Employee before starting the Game.
      8. Performing tasks during the Games does not require the use of excessive physical force. The Participant is obliged to adhere to this recommendation.
      9. During the Game, it is forbidden to:
      10. destroy or damage the equipment of the Room, as well as perform actions threatening the destruction or damage of the Room's equipment,
      11. climb on furniture or other elements of equipment,
      12. consume meals or drinks,
      13. smoke cigarettes or other tobacco products, as well as use electronic cigarettes or tobacco heaters,
      14. consume alcohol or take any other intoxicating substances,
      15. use the equipment of the Room not according to its intended purpose or the rules of the Game,
      16. block or obstruct the exit from the Room,
      17. record the course of the Game,
      18. take photos.
      19. Participants are responsible for any damages in the Room or at the game's location caused by reasons attributable to them, particularly due to non-compliance with the prohibitions mentioned in para. 9.
      20. Gamescape is not responsible for damages to property or person on the side of the Participants, which occurred for reasons independent of Gamescape, particularly resulting from non-compliance by the Participant with the provisions of the law or the rules specified in the Regulations or communicated by a Gamescape Employee.
      21. Gamescape has the right to interrupt the Game or to deny a Participant participation in the Game in the following cases:
        1. if – despite a single warning by a Gamescape Employee – the Participant behaves in a manner violating the rules of fair play or the rules of social coexistence,
        2. non-compliance by the Participant with the provisions of the Regulations, including in particular:
          • any attempt to record the course of the Game by the Participant or taking photos,
          • using unjustified or excessive force by the Participant or other aggressive behavior, including destroying elements of equipment located in the Room,
          • non-compliance by the Participant with instructions from a Gamescape Employee,
          • consumption of alcohol by the Participant or other intoxicating substances, or being under the influence of the aforementioned substances.
        3. In the cases mentioned in para. 12, neither the Participants nor the Booker are entitled to a refund of money.

CITY GAMES

      1. The rules described in this paragraph in para. 1, 3-4, and 10-13 apply accordingly to City Games (Escape City).
      2. Participants are obliged to observe generally accepted safety rules and to know and adhere to traffic regulations. Gamescape is not responsible for any events and damages that are the result of ignorance or non-compliance by the Participant with the aforementioned rules, as well as resulting from reasons independent of Gamescape, including the actions of third parties, weather conditions, or force majeure.

PARTICIPATION OF MINORS

      1. Minors (up to the age of 18) may participate in Escape Room type Games and City Games under the rules specified in the following paragraph.
      2. A minor may participate in an Escape Room type Game or City Game:
        1. up to the age of 14 – if their adult guardian is also a Participant in that Game and supervises and oversees the minor Participant;
        2. from 14 to the age of 18:
          • if their adult guardian is also a Participant in that Game and supervises and oversees the minor Participant,

or – exclusively in the case of an Escape Room type Game

      • if their adult guardian is present in the Gamescape premises throughout the duration of the Game,
      • if they provide Gamescape with a signed consent from parents or legal guardians for participation in the Game.
      1. In the case of organized groups consisting of minors mentioned in this paragraph, the number of required adult guardians is determined individually with a Gamescape Employee and depends on the number of Game Participants.
      2. Responsibility for a minor Participant, as mentioned in § 3, is jointly borne by their adult guardian or guardians, as mentioned in para. 2-3, and the Booker.

PARTICIPATION IN AN ESCAPE ROOM TYPE GAME

      1. The minimum and maximum number of participants, the time limit for completing a specific Escape Room type Game, and any age restrictions are specified in the description of individual game variants available on the Gamescape website https://gamescape.pl/ and by Gamescape Employees.
      2. An Escape Room type Game ends either when the Participants complete all the tasks planned in the given Game or when the time allotted for that Game expires – depending on which of these events occurs first.
      3. The tasks planned in a given Game are variable and may be modified at the discretion of Gamescape (especially for technical reasons or as part of evaluation).
      4. Participants of an Escape Room type Game should appear at the Gamescape premises no later than 15 minutes before the start of the Game, to present the rules of the Game by a Gamescape Employee and to complete all formalities.
      5. If Participants arrive after the time reserved for an Escape Room type Game, the time limit for completing the Game is reduced by the delay time and the time needed to introduce Participants to the rules of the Game.
      6. During the Game, Participants have constant contact with a Gamescape Employee, who, if necessary, communicates with the Participants, e.g., providing tips or hints needed to solve individual tasks, and also pays attention to incorrect behaviors of the Participants. Any situations that cause concern among the Participants should be immediately reported to a Gamescape Employee. Participants are also required to consult with a Gamescape Employee about any situations that raise their doubts about the compliance of certain behaviors with the Regulations (e.g., using force, the permissibility of using a specific element of equipment).
      7. Cameras are installed in the Rooms, allowing a Gamescape Employee to monitor the room and the course of the Game. The recording from the monitoring can be recorded, to ensure the safety of Participants and the protection of Gamescape's property. This recording may be stored for no longer than 60 days, and in cases justified by a legal interest of Gamescape – until the expiration of claims. By entering the Room, the Participant consents to the recording of their image for the aforementioned purposes.
      8. Participants acknowledge that, as a result of violations of the Regulations, Gamescape may be forced to disable the Room, in which a specific variant of the Escape Room type Game is conducted, which will prevent Gamescape from conducting this variant of the Game and necessitate the cancellation of reservations made, which may expose Gamescape to damages. In such a case, Participants will be liable to Gamescape for lost benefits.

PARTICIPATION IN A CITY GAME (ESCAPE CITY)

      1. The minimum and maximum number of participants, the time limit for completing a City Game, and any age restrictions are specified in the description of individual game variants available on the Gamescape website https://gamescape.pl/ and by Gamescape Employees.
      2. A City Game begins at the Gamescape premises or another location specified by Gamescape.
      3. A City Game ends either when the Participants complete all the tasks planned in the given Game or when the time allotted for that Game expires – depending on which of these events occurs first.
      4. The tasks planned in a given Game are variable and may be modified at the discretion of Gamescape (especially for technical reasons or as part of evaluation).
      5. Participants of a City Game should appear at the start location, as mentioned in para. 2, no later than 15 minutes before the start of the City Game, to present its rules by a Gamescape Employee, a brief instruction on using the equipment, as mentioned in para. 6, and to complete all formalities.
      6. Gamescape provides Participants with electronic equipment (iPad) and a set for the City Game (collectively, "Equipment") for the duration of the City Game, which includes props and tools necessary to perform the tasks during the City Game.
      7. The electronic equipment (iPad), as mentioned in para. 6, has a built-in GPS system that allows determining the exact location of the device. By participating in the Game, Participants confirm that they are aware of this and give their consent.
      8. When renting the Equipment, one of the Participants participating in the given City Game signs a document to confirm the receipt of the Equipment from a Gamescape Employee and to confirm that the Equipment was issued in fully operational condition, without visible damage. Any irregularities in the appearance or operation of the Equipment should be reported to Gamescape immediately.
      9. After completing the City Game or the expiration of the time allotted for it, Participants are obliged to return the Equipment to the Gamescape premises or another agreed-upon location, within no later than 30 minutes of the end of the Game. In case of a delay in returning the Equipment, if it prevents Gamescape from conducting subsequent City Games, Participants will be jointly obliged to pay Gamescape a fee for extending the rental of the Equipment in the amount of 100 PLN for each started 30 minutes.
      10. The Participant undertakes to:
        1. use the Equipment according to its properties and exclusively for purposes related to the City Game;
        2. not modify the software provided on the electronic equipment, not install additional programs, not remove installed programs, and not perform other actions that may hinder or prevent further use of the device by Gamescape or other Participants.
        3. not entrust the Equipment to third parties not participating in the same City Game;
        4. return the Equipment in an undeteriorated condition.
      11. In case of non-compliance with the provisions of the Regulations, especially para. 10, Participants will be jointly obliged to cover the costs incurred by Gamescape as a result of their violations, in particular the costs of restoring the Equipment to its previous condition (including the cost of work employed for this purpose), its repair or repurchase.
      12. Participants acknowledge that, as a result of violations of the provisions of the Regulations, especially para. 10 of this paragraph, Gamescape may be forced to disable the Equipment or its individual elements, which will prevent Gamescape from conducting the specific variant of the City Game and necessitate the cancellation of reservations made, which may expose Gamescape to damages. In such a case, Participants will be liable to Gamescape for lost benefits.

PROVIDING LOCKERS

      1. During the Game, Gamescape provides Participants with lockable lockers, where they can leave personal items and outerwear. Participants are responsible for properly locking the locker and keeping an eye on the key. The lockers are not intended for storing items of significant value and are not secured in any way other than by a lock locked with a key provided to the Participants.
      2. After the completed Game, the Participant should collect all items left in the locker, as mentioned in para. 1, and return the key to a Gamescape Employee. If the aforementioned items are not collected on time and the key is not returned immediately after the end of the Game, Participants will be required to pay Gamescape a fee for extending the use of the locker in the amount of 50 PLN for each started day.
      3. In case of loss of the key, the Participant is obliged to pay Gamescape a fee in the amount of 100 PLN.

IMAGE OF PARTICIPANTS

      1. Participants who, in connection with participation in the Game, including after its completion, agree to have their photograph taken by a Gamescape Employee, also express their consent to the free placement of the photographic material on the website or on the Gamescape channels in social media.
      2. In the case of a Participant under the age of 16, the consent, as mentioned in para. 1, is expressed by the guardian of that Participant.
      3. The Participant or their guardian may withdraw the consent, as mentioned in para. 1 and 2, at any time, and then the materials containing the image of the Participant will be removed. The statement of withdrawal of consent should be submitted in writing or by email to the address: hello@gamescape.pl.
      4. Cameras are installed at the Gamescape premises. The recording from the monitoring can be recorded, to ensure the safety of Participants and the protection of Gamescape's property. This recording may be stored for no longer than 60 days, and in cases justified by a legal interest of Gamescape – until the expiration of claims. Persons staying on the premises of Gamescape consent to the recording of their image for the aforementioned purposes.

USE OF THE PARTY ROOM

 

      1. When making a reservation for an Escape Room type Game or a City Game, the Booker may additionally reserve the Party Room. In such a case, Gamescape individually agrees with the Booker on the time and price of the reservation.
      2. The purpose and method of using the Party Room by the Booker, including the rules for organizing and bringing in their own non-alcoholic beverages and food products, should be individually agreed upon with Gamescape. Gamescape does not organize catering or any other food services.
      3. In the case of reserving the Party Room by the Booker, after completing an Escape Room type Game or City Game, Gamescape makes the Party Room available to Participants for a time no longer than 30 minutes from the completion of the Game. The Party Room may not be used by persons who were not Participants in the Games, unless they are a parent or legal guardian of a minor Participant.
      4. Extending the time of using the Party Room can only take place after prior arrangements made by the Booker or Participant with Gamescape, no later than one day before the day on which the Game was reserved, provided that the Party Room is available at that time.
      5. Within the Party Room, Gamescape provides Participants with: tables and benches, plates, cutlery, napkins, and – depending on the needs – glasses or wine glasses.
      6. In the Party Room, it is forbidden to:
        1. bring in one's own alcoholic beverages and any other intoxicating substances;
        2. scatter confetti, glitter, and use popping confetti tubes;
        3. destroy or damage the equipment of the Party Room, as well as perform actions threatening the destruction or damage of the Party Room's equipment;
        4. smoke cigarettes or other tobacco products, as well as use electronic cigarettes or tobacco heaters.
      7. Gamescape has the right to deny a Participant entry or to expel from the Party Room in the case when:
        1. the behavior of the Participant indicates intoxication or being under the influence of other intoxicating substances;
        2. the behavior of the Participant is contrary to the provisions of the Regulations, particularly the preceding paragraph.
      8. Participants are obliged to leave the Party Room in the condition found, in particular to:
        1. clean up after themselves all generated waste,
        2. take with them all items brought into the Party Room, food, and drinks.
      9. In case Participants fail to comply with the provisions of the preceding paragraph, Gamescape will be entitled to charge the Booker or Participants jointly for the cleaning costs of the Party Room.

MOBILE ESCAPE ROOM – ESCAPE BOX

 

      1. The Booker should appear at the Gamescape premises during Gamescape's working hours on the day determined during the reservation, to collect the Escape Room type Game called Escape Box.
      2. When issuing the Escape Box, Gamescape collects a deposit from the Booker in the amount of 200 PLN.
      3. When renting the Escape Box, the Booker signs a document to confirm the receipt of the Escape Box from a Gamescape Employee and to confirm that it was issued in fully operational condition, without visible damage. Any irregularities in the appearance or operation of the Escape Box should be reported to Gamescape immediately.
      4. The Booker is obliged to return the rented Escape Box to the Gamescape premises along with all elements of its equipment the next day after the day of reservation. At the time of return – if there are no objections regarding the returned equipment – Gamescape returns the deposit to the Booker, as mentioned in para. 2.
      5. In case of a delay in returning the Escape Box, the Booker will be obliged to pay Gamescape the costs of further rental of the Game according to Gamescape's rates, corresponding to the time of delay in return.
      6. The Booker reserving the Escape Room type Game called Escape Box undertakes to:
        1. use the Escape Box according to its properties and exclusively for purposes related to the Game;
        2. not entrust the Escape Box to third parties not participating in the Game with the Booker;
        3. return the Escape Box in an undeteriorated condition.
      7. In case of non-compliance with the provisions of the Regulations, particularly para. 6, the Booker will be obliged to cover the costs incurred by Gamescape as a result of his violations, particularly the costs of restoring the Escape Box or its elements to the previous condition, repair or repurchase.
      8. The Booker acknowledges that, as a result of destruction or loss of the Escape Box or its elements or violation by the Booker of para. 4 sentence 1 and para. 6, Gamescape may be forced to disable the use of the Escape Box and cancel subsequent reservations, which may expose Gamescape to damages. In such a case, Participants will be liable to Gamescape for lost benefits.

PARTICIPATION IN AN ONLINE ESCAPE GAME – VIRTUAL ESCAPE ROOM

      1. The minimum and maximum number of participants and the time limit for completing the Game are specified in the description of individual variants of the Escape Online type Game available on the Gamescape website https://gamescape.pl/.
      2. To participate in the Escape Online type Game, the Participant must have a device with access to stable Internet.
      3. The costs of using the Internet are borne by the Participant at their own expense.
      4. Gamescape is not responsible for the interruption of the Escape Online type Game due to reasons independent of Gamescape, particularly related to the technical condition of the User's equipment or interruptions in the provision of services by the Participant's internet provider.

COMPLAINTS

      1. Complaints regarding services provided by Gamescape may be submitted by the Participant or Booker in writing to the address: Kościuszki St. 74, 30-114 Krakow or via email to the address: hello@gamescape.pl.
      2. Gamescape undertakes to respond to the complaint promptly, no later than within 14 days from the day of its submission.
      3. Gamescape will provide the Participant with a decision regarding the complaint to the address indicated by him, whether it be a postal address or email address.

FINAL PROVISIONS

    1. For damages incurred on the side of Gamescape and for fees and other liabilities towards Gamescape, Participants participating in the Game as part of one group are jointly liable.
    2. In matters not regulated in the Regulations, applicable provisions of the law shall apply accordingly, particularly the Civil Code.
    3. The proper law for any disputes between the Booker or Participants and Gamescape is Polish law. The common courts in Poland competent for the seat of Gamescape shall have jurisdiction to resolve disputes.
    4. The provisions of para. 3 do not infringe upon the absolutely binding provisions of the law establishing different law applicability or jurisdiction in matters involving consumers.
